What Is A Theft Charge?

A theft charge is legally defined as unlawfully appropriating property with the intent to deprive the owner of said property. Theft offenses range from a Class C Misdemeanor to a First Degree Felony. Each level comes with its own set of punishments and requirements.

The Law of Theft:
Theft Law Definitions
Sec. 31.03. THEFT. (a) A person commits an offense if he unlawfully appropriates property with intent to deprive the owner of property.

(b) Appropriation of property is unlawful if:
(1) it is without the owner’s effective consent;
(2) the property is stolen and the actor appropriates the property knowing it was stolen by another; or
(3) property in the custody of any law enforcement agency was explicitly represented by any law enforcement agent to the actor as being stolen and the actor appropriates the property believing it was stolen by another.

Different Levels of Theft Charges:

Class C Misdemeanor:
Less than $100
Class B Misdemeanor:
Between $100-$750
Less than $100 BUT with a previous conviction.
Theft of a driver’s license, CDL, or any personal identification.
Class A Misdemeanor:
Between $750-$2,500
State Jail Felony:
Between $2,500-$30,000
Theft of property of a person (taking someone’s wallet), regardless of value.
From a human corpse or grave, regardless of value.
Theft of a firearm, regardless of value.
Less than $2,500 BUT with two previous convictions.
Third Degree Felony:
Theft $30,000-$150,000
Second Degree Felony:
Between $150,000-$300,000
Theft from an ATM machine.
First Degree Felony:
Theft $300,000 or more.
